Dear members,
Fair Work Legislation (Closing Loopholes) Bill 2023
Ian Macdonald of APTIA has brought to our attention that the Commonwealth Government has issued its third package of IR Reform. The Bill is over 280 pages and has significant implications for our industry. See here: Closing the Loopholes Bill
You can view an APTIA e-alert here.
The areas of significance include:
- A new definition of casuals.
- Union delegates rights.
-
Inclusion with the Road Transport Industry legislation.
- Wages theft.
Ian, also notes the following:
That on 7 September the Fair Work Legislation Amendment (Closing the Loopholes) Bill 2023 enjoyed its second reading in the House of Representative and was then referred to the Senate, who, in turn voted to send the Bill to the Senate Education and Employment Legislation Committee for consideration and report back, no later than 2 February 2024.
The Senate insisted on sufficient time being given to consider such a significant piece of legislation, , which I agree with. At the moment the challenge is to try to understand what the Bill actually does.
APTIA's intention is to make a submission to the Senate Select Committee, but only after careful consideration of the Bill's impacts. We will also need to advocate our position to the cross bench.
To this extent, there will be an Industrial Working Group this week to discuss and settle our submissions, BAV will be part of those discussions.
